ok so i got the windows 8 devolper thing to test it out and when i went to volume it says audio service not working so i went to services.msc>windows audio>start
and it does start and gives me error 1297 ill take a picture
anyone else get the same problem?

Could a driver need to be installed?

i updated all my drivers before running it so as far as i know i dont need a driver cause on my main partition my audio works properly

Maybe you need to atleast download them on your windows 8 to have it recognize the drivers

thats what i meant i installed the updates from my main partition to the windows 8

Windows 8 developer doesn't mean its a beta, not even alpha so errors may occur as often as in vista :P

Don't use it as default os yet.
