Because thepiratebay is actually providing illegal content. The FBI would then have sort of a right to shut it down, and the DNS being in the US would just make it easier.
ThePirateBay does not hot illegal content, therefore they don't have the right to shut it down. All the content is hosted on the users computer, but thepiratebay only hosts trackers info and such.

Whereas the judge said that TBB was explicitly advertising to to users to download their torrents and they knew it was illegal.
